About This Policy
These Terms govern access to and use of the GTCFX /en-intl Website operated by GTC Global Trading Ltd.
Trading accounts and financial services are governed separately by the applicable Client Agreement and related legal documents.
By accessing or using this Website, you agree to be bound by these Terms.
Website content is provided for general information only and does not constitute personal financial advice.
Trading accounts and services are governed by separate agreements and disclosures.
You must be at least 18 years old and have legal capacity to accept these Terms.
The English version controls where translations are inconsistent, subject to applicable law.
Introduction
For the purposes of these Terms, the international website pages available at https://www.gtcfx.com/en-intl/ and the related pages made available through that route (the "Website") are operated by GTC Global Trading Ltd ("GTCFX", the "Company", "we", "us" or "our"). The Company is a private limited company incorporated under the laws of the Autonomous Island of Anjouan, Union of the Comoros, with company number 16283 and registered address at Boulevard de Coalancanthe, Mutsamudu, Anjouan, Union of the Comoros. The Company holds licence no. L16283/GTC issued by the Anjouan Offshore Finance Authority ("AOFA").
These Terms apply only to access to and use of the Website. If you open or maintain a trading account with the Company, the financial products, trading services, orders, payments and account relationship are governed by the applicable Client Agreement, Risk Disclosure, execution policies and other documents accepted or provided during onboarding. If there is any inconsistency, the Client Agreement prevails in relation to the trading account or financial service, and these Terms continue to govern use of the Website.
The Website is not directed at any person in a jurisdiction where its publication, availability or use would be unlawful or would require an authorisation that the Company does not hold. You are responsible for ensuring that your access to and use of the Website is lawful in your location and for complying with the Restricted Countries Policy.
Intellectual Property Rights
Unless otherwise stated, all text, graphics, interfaces, software, source code, databases, data compilations, charts, audio, video, logos, trademarks, trade names, documents and other materials made available on the Website are owned by, or licensed to, the Company or the relevant third-party rights holder. GTCFX branding and related marks may not be used without the prior written permission of the relevant rights holder.
Subject to these Terms, the Company grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and view the Website for your personal use or legitimate internal business use. No ownership or other intellectual property rights are transferred to you. All rights not expressly granted are reserved.
Restrictions
Unless expressly permitted by the Company in writing or required by applicable law, you must not:
• copy, reproduce, modify, republish, distribute, sell, sublicense, publicly display or commercially exploit Website content;
• use automated systems, bots, scrapers, data-mining tools or similar methods to extract or collect Website content, account data or personal data;
• interfere with, overload, disrupt, reverse engineer, circumvent or attempt to defeat any security, authentication, access-control or technical measure used by the Website;
• introduce malware, malicious code, denial-of-service attacks or any material intended to damage or compromise the Website or another person;
• attempt to gain unauthorised access to the Website, a trading platform, an account, a server, a database or another user's information;
• impersonate another person, misrepresent your identity or authority, or submit false, misleading or fraudulent information;
• use the Website to infringe intellectual property, privacy or other rights, to distribute unsolicited advertising, or to engage in unlawful, abusive or fraudulent conduct; or
• use the Website in any manner that breaches applicable law, sanctions, these Terms or any applicable Client Agreement.
Any username, password, authentication code or other security credential issued to you is confidential and must be protected from unauthorised use. You must notify the Company promptly if you become aware of any suspected compromise or unauthorised access.
The Company may restrict or suspend Website access where reasonably necessary to protect security, comply with law, investigate suspected misuse or maintain the Website. Any suspension or termination of a trading account or financial service is governed separately by the applicable Client Agreement.
Your Content
In these Terms, "Your Content" means information, documents, messages, feedback or other materials that you submit through the Website. You represent that Your Content is lawful, accurate to the best of your knowledge, and that you have the necessary rights and authority to submit it.
You grant the Company a non-exclusive, worldwide and royalty-free licence to receive, host, reproduce, transmit and otherwise process Your Content only to the extent reasonably necessary to operate the Website, respond to requests, provide support, meet legal and compliance obligations, maintain records, prevent fraud and exercise the Company's rights under these Terms. The Company may permit its service providers to process Your Content for those purposes, subject to appropriate obligations.
Personal data contained in Your Content will be handled in accordance with the Privacy Policy and applicable law. Nothing in this clause authorises the public disclosure of your personal data, identity documents or confidential account information. Information may be retained where required by law, regulation, legal process, security requirements or the Company's legitimate record-keeping obligations.
The Company may remove or refuse unlawful, infringing, harmful or technically unsafe content, but is not required to monitor every submission. Unsolicited product suggestions or general feedback may be used to improve the Website, provided that this does not override confidentiality, privacy or client-data obligations.
No warranties
To the maximum extent permitted by applicable law, the Website is provided on an "as is" and "as available" basis. The Company does not warrant that the Website will always be available, uninterrupted, secure, error-free, free from harmful components, or that all information will always be complete, accurate or current.
Website content is provided for general information only. It does not constitute personal investment, financial, legal or tax advice; an offer, recommendation or solicitation to enter into a transaction; or a representation that a product, strategy or service is suitable for you. Market data, prices, charts and third-party content may be delayed, indicative, incomplete or different from executable prices available on a trading platform.
You should review the applicable Client Agreement, Risk Disclosure and product information and obtain independent professional advice where appropriate before making a financial decision. Nothing in these Terms excludes any warranty, right or remedy that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by applicable law, the Company and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss arising out of or in connection with access to, use of, inability to use, or reliance on the Website, including loss of profit, revenue, business opportunity, goodwill or data.
The exclusions in this clause do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, or death or personal injury caused by negligence where applicable law prohibits exclusion. Where liability cannot be excluded, it will be limited only to the minimum extent permitted by applicable law.
Trading losses, execution matters, margin requirements, account suspensions and liabilities arising from financial services are not determined by these Website Terms and are governed by the applicable Client Agreement and related legal documents.
Indemnification
To the extent permitted by applicable law, you will indemnify the Company and its directors, officers, employees and agents against reasonably incurred losses, liabilities, claims, damages and costs arising directly from your material breach of these Terms, unlawful or fraudulent use of the Website, infringement of a third party's rights, or introduction of malicious code by you or through systems under your control.
This indemnity applies only to the extent that the relevant loss was caused by your conduct and does not apply to loss caused by the Company's fraud, wilful misconduct, negligence or breach of law. The Company will take reasonable steps to mitigate recoverable loss and will not settle a third-party claim in a manner that imposes a non-monetary obligation on you without your reasonable consent.
Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the relevant provision will be severed. The remaining provisions will continue in full force and effect.
Variation of Terms
The Company may update these Terms from time to time to reflect changes in law, regulation, security requirements, technology, Website functionality or business operations. The revised Terms will identify the date on which they were last updated and will take effect when published on the Website, unless a later effective date is stated.
Where required by law, or where a change materially affects Website users, the Company will provide reasonable notice through the Website or available contact details. Continued use of the Website after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Website.
A change to these Terms does not amend a Client Agreement unless that agreement is separately amended in accordance with its own terms. These Terms will not retrospectively remove accrued rights except where required or permitted by applicable law.
Assignment
You may not assign, transfer or subcontract your rights or obligations under these Terms without the Company's prior written consent.
The Company may assign or transfer these Website Terms to an affiliate or successor as part of a lawful reorganisation, merger, sale or transfer of the Website or relevant business, provided that the transfer does not reduce any non-excludable rights you have under applicable law. Where reasonably practicable and materially relevant, notice will be provided through the Website.
This clause does not transfer or novate a trading account, financial service or Client Agreement. Any such transfer is governed by the applicable Client Agreement, regulatory requirements and mandatory law.
Entire Agreement
These Terms, together with the policies expressly incorporated into them, constitute the entire agreement between you and the Company concerning access to and use of the Website and supersede prior understandings concerning Website use only.
These Terms do not replace or override the applicable Client Agreement, Privacy Policy, Cookie Policy, Risk Disclosure, Restricted Countries Policy or any product-specific terms. Each of those documents applies according to its subject matter. If a translated version of these Terms is inconsistent with the English version, the English version will prevail to the extent permitted by applicable law.
A failure or delay by the Company to exercise a right under these Terms does not waive that right. Headings are included for convenience and do not affect interpretation.
Governing Law & Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them will be governed by the laws applicable to the Company in the Autonomous Island of Anjouan, Union of the Comoros.
Subject to any mandatory rights or jurisdiction available to you under applicable law, the courts of competent jurisdiction in Anjouan, Union of the Comoros will have non-exclusive jurisdiction over disputes arising out of or in connection with these Terms or use of the Website.
This clause applies to Website use only. The governing law, dispute-resolution process and jurisdiction applicable to a trading account or financial service are set out separately in the applicable Client Agreement.
